Compensation After a Motorcycle Crash in New Jersey
Motorcycle accidents can result in serious injuries, emotional trauma, and major financial consequences. In New Jersey, injured riders and families who have lost someone in a crash may be eligible to receive compensation. Here’s a breakdown of what that may include and how the process works:
- Medical expenses:
You can seek compensation for all accident-related medical costs, including emergency care, hospital stays, surgeries, rehabilitation, medications, and future treatment needs. - Lost income and reduced earning ability:
If the crash caused you to miss work or limited your ability to earn a living long-term, you may recover lost wages and compensation for reduced future income. - Pain and suffering:
This refers to the physical pain and emotional distress caused by the accident. It can be a significant part of a settlement, especially in serious or life-altering injuries. - Property damage:
You may be compensated for the cost of repairing or replacing your motorcycle and any damaged gear (helmet, riding jacket, etc.). - Wrongful death damages:
In fatal accidents, surviving family members may be able to recover funeral and burial costs, as well as compensation for loss of companionship and financial support. - No PIP coverage for motorcyclists:
Unlike car drivers, motorcycle riders in New Jersey aren’t covered by Personal Injury Protection (PIP). This means injured riders usually need to file a claim against the at-fault driver or pursue a lawsuit. - Modified comparative negligence:
New Jersey law allows you to seek compensation as long as you’re less than 51% at fault for the accident. However, your compensation will be reduced based on your share of the blame.
Motorcycle crashes often involve high speeds, low visibility, and very little physical protection for the rider. Because of this, injuries are often severe, and the consequences can be life-changing. Riders face a higher risk of brain trauma, spinal cord injuries, broken bones, and even fatal outcomes compared to drivers in enclosed vehicles.
If you or someone you love has been injured in a motorcycle accident in New Jersey, working with a motorcycle accident attorney can make a real difference. An attorney can help investigate the crash, determine who was at fault, and handle communication with insurance companies. Legal support also ensures that your rights are protected as you seek compensation for medical bills, lost wages, pain and suffering, or, in fatal cases, wrongful death damages.
